These general conditions of use and legal information (hereinafter, General Conditions) apply to the website of REAL WG LLC. (hereinafter, 4 LABS DETAIL), whose domain is www.4labsdetail.com and the corresponding mobile application.
Through these General Conditions, 4 LABS DETAIL makes available to users (hereinafter User or Users) the website and mobile application 4 LABS DETAIL (hereinafter referred to collectively as the Platform).
In compliance with established regulatory requirements, the following identifying data of the site owner are set out below:
4 LABS DETAIL is a company whose main activity is the acquisition of customers for on-site vehicle washing performed by qualified professionals. To this end, it has a technological platform through which, via a mobile application or a website (hereinafter, the APP), it allows individuals interested in hiring vehicle cleaning services to reserve the day, time, and location for the performance of the service. Currently, the Application is exclusively directed at users residing in Mallorca. Users who reside or are domiciled elsewhere and choose to access and/or use this Application do so at their own risk and responsibility and must ensure that such access and/or use complies with applicable local legislation.
By accessing and using this Application and Website you (“User”) acknowledge that you have read and accepted these General Conditions of Use and agree to comply with all its terms and conditions. Furthermore, the User acknowledges and accepts that access and use of this Application and/or Website will be subject to the General Conditions of Use in force at the time of access. 4 LABS DETAIL reserves the right to modify these General Conditions of Use at any time, as well as any other general or specific conditions that may apply. The User may notify 4 LABS DETAIL via email at info@4labsdetail.com if they do not accept any eventual modification of these General Conditions. Likewise, 4 LABS Detail reserves the right to suspend, interrupt, or stop operating the Application and/or the Website at any time.
Furthermore, the term "Cleaner" used in this document refers to the network of vehicle washers who are independent professionals collaborating with 4 LABS DETAIL and who, within a determined timeframe, commit to performing the washing service entrusted by the Customer through the aforementioned mandate.
Throughout these General Conditions of Use, we will refer to Customers as Users.
Through the Application, 4LABS DETAIL provides the User with a vehicle washing service (hereinafter, the “Service”). The Application and/or Website provide the User with access to various contents, information, and data provided by 4LABS DETAIL in relation to the vehicle washing Service (hereinafter, the “Contents”). 4LABS DETAIL reserves the right to modify the presentation, configuration, and location of the Application and/or the Website at any time, as well as the corresponding access and use conditions. 4LABS DETAIL does not guarantee that the Contents provided through the Application and/or Website will be in all cases correct, complete, or up-to-date.
Access to the Platform, and the voluntary creation of a profile by the User, implies the knowledge and the express and unequivocal acceptance of these General Conditions, the Privacy Policy, and the Cookies Policy by all Users.
In order to be a Customer of the Platform, it is essential that the following requirements are met:
The User acknowledges and accepts that access and use of the Application and/or Website take place freely and consciously, under their exclusive responsibility. 4LABS DETAIL shall not be liable under any circumstances for the use that the User and/or third parties may make of the Application and/or Website, nor for any damages that may arise therefrom. The User undertakes to make appropriate and lawful use of the Application and/or Website in accordance with applicable legislation and these General Conditions of Use. The User must refrain from (i) making unauthorized or fraudulent use of the Application and/or Website; (ii) accessing or attempting to access restricted resources of the Application and/or Website; (iii) using the Application and/or Website for illicit purposes, illegal effects, or those contrary to the provisions of these General Conditions of Use, harmful to the rights and interests of third parties, or that in any way may damage, disable, overload, or prevent the normal use or enjoyment of the Application and/or Website; (iv) causing damage to the Application and/or Website or to the systems of its providers or third parties; (v) introducing or spreading computer viruses or any other physical or logical systems that are susceptible to causing damage to the systems of 4LABS DETAIL, its providers or third parties; (vi) attempting to access, use, and/or manipulate the data of 4 LABS Detail, third-party providers, and other users; (vii) reproducing, copying, distributing, transforming, or modifying the Contents, or allowing access to third parties through any form of public communication, unless authorized by the holder of the corresponding rights or if legally permitted; (viii) obtaining or attempting to obtain the contents using means or procedures other than those that, depending on the case, have been made available for this purpose.
The User may only access the Application and/or Website through authorized means. 4LABS DETAIL shall not be responsible if the User does not have a compatible device or has downloaded a version of the Application that is incompatible with their device.
The User guarantees that all data regarding their identity and legitimacy provided to 4LABS DETAIL in the Platform's registration forms are true, accurate, and complete. Likewise, the User undertakes to keep their data updated.
In the event that the User provides any false, inaccurate, or incomplete data, or if 4LABS DETAIL considers that there are founded reasons to doubt their truthfulness, accuracy, or integrity, 4LABS DETAIL may deny present or future access to and use of the Platform or any of its contents and/or services.
By registering on the Platform, the User will select a username and an access code (password). Both the username and the password are strictly confidential, personal, and non-transferable.
The User undertakes not to disclose data regarding their account nor make it accessible to third parties. The User shall be solely responsible for the use of such data by third parties, including statements made on the Platform, or any other action carried out through the use of the username and/or password.
4LABS DETAIL cannot guarantee the identity of registered Users; therefore, it shall not be responsible for the use of a registered User's identity by unregistered third parties. Users are obliged to immediately inform 4 LABS Detail of the theft, disclosure, or loss of their username or password, communicating it through the Contact section.
Access to the Application shall be subject in all cases to the prior registration of the User by completing the corresponding form (“Register now”), which will be previously provided to the User. 4LABS DETAIL reserves the right to freely accept or reject the registration request by the User. The data entered by the User in the Registration Form must be accurate, current, and truthful at all times and shall include the user's ID number. Access to and use of the Application or the specific area of the Website shall be subject to a password assigned to the User by 4LABS DETAIL upon filling out the Registration Form, and access shall be deemed carried out by said User, who shall be responsible in all cases for such access and use. The User shall be responsible at all times for the custody of their password, assuming, consequently, any damages that may derive from its improper use, as well as the assignment, disclosure, or loss of the same. In case of forgetting the password or any other circumstance that poses a risk of access and/or use by unauthorized third parties, the User shall immediately notify 4LABS DETAIL so that the latter may proceed immediately to block and replace it. In any case, any operations carried out before such communication shall be deemed performed by the User, who shall be responsible and pay for the expenses and/or damages derived from any unauthorized access and/or use carried out prior to said communication.
Since 4LABS DETAIL cannot guarantee the identity of registered Users, Users shall have the obligation to inform 4LABS DETAIL in those instances where they are aware that the credit card associated with their 4LABS DETAIL profile has been stolen, and/or is being used by a third party in a fraudulent manner. Therefore, since 4LABS DETAIL and its payment platform proactively monitor User protection with corresponding security measures, in the event that the User does not inform 4LABS DETAIL of such theft, 4LABS DETAIL shall not be responsible for any fraudulent use that third parties may make of the User's account.
When a User registered as a Customer needs to have their vehicle washed, they must go to the web platform or the corresponding application of 4LABS DETAIL and request the service through said electronic means.
The Customer is solely responsible for the correct entry of the addresses where the washing service is to be carried out on the Platform, thus exempting 4LABS DETAIL and the Cleaner from any negligence or error in the execution of the order resulting from the incorrect entry of the service addresses. Consequently, the Customer shall bear any possible contingencies arising from the incorrect entry of the addresses for the service.
The Customer must provide all information, in as much detail as possible, regarding the washing service requested from the Cleaner. For this purpose, they may enter any comments they consider useful in the section “anything we should know?”. The Customer shall maintain constant communication with 4LABS DETAIL, and may contact the Cleaner at any time so that the latter may execute the mandate conferred according to the Customer's own instructions.
The Customer exempts 4LABS DETAIL and the Cleaner from any negligence or error in the instructions provided for the execution of the service requested on their behalf. Consequently, the Customer shall bear any possible consequences resulting from the incorrect entry of service instructions on the Platform (i.e. incorrect address, incorrect product).
If the Customer does not answer calls, the Cleaner will wait 10 minutes before leaving in those cases where the service cannot be performed due to lack of communication with the customer.
In the event that the Customer wishes to make a claim regarding the performance of a service, they must go directly to the contact section of the app or website. In the case of a refund of the service amount by 4LABS DETAIL to the Customer, 4LABS DETAIL shall have the power to decide the method of return (transfer, credit card, purchase voucher, etc.). Therefore, the refund of the amount for a service contracted through 4LABS DETAIL in execution of the mandate conferred by the Customer shall be subject in all cases to the refund policy of 4LABS DETAIL.
Registration and use of the Platform for Customers is completely free. The fees charged shall be non-refundable.
The Customer only needs to pay for each service requested through the Platform. By registering through the Platform and providing the required banking information, the User expressly authorizes 4LABS DETAIL to process the receipts corresponding to the payment of the requested services.
The Customer has the right to know the rate of their service before contracting it and formalizing the payment. The User is recommended to periodically access the Application and/or the Website to know the rates applicable at any given time. The rate for the washing service may vary when force majeure circumstances occur that are beyond the control of 4LABS DETAIL and entail an increase in said rate.
4LABS DETAIL reserves the right to modify its prices at any time. Changes made will take effect immediately upon publication. The User expressly authorizes 4LABS DETAIL to send, via electronic means to the email address provided during the registration process, the receipt of the services contracted and/or the generated invoices. In case an invoice is required, the user must add their tax data (ID or Tax ID, etc.) to the platform before placing the order.
Subsequent cancellation of the service by the user, in cases where a Cleaner has already been assigned, will empower 4LABS DETAIL to charge the Customer the fee for services already started by the Cleaner. This is without prejudice to the Customer's right to request a new service.
It is strictly forbidden for a User to create different 4LABS DETAIL accounts or share an electronic payment method with other Users in order to improperly benefit from discounts and invitations, which is considered an abusive use. Invitations and discounts will lose their value three months after their creation.
Payment for services made by Customers is received into the accounts of 4LABS DETAIL through an Electronic Money Institution. Electronic Money Institutions are authorized to provide regulated payment services in all territories where 4LABS DETAIL operates and comply with current regulations regarding payment services for Platforms such as 4LABS DETAIL. 8. Price of services listed on the Platform
All prices indicated on the Platform include any taxes that may be applicable depending on the territory from which the User operates and in all cases will be expressed in the current currency based on the territory from which the User operates.
In accordance with Clause 6 above, the prices applicable to each service will be those published on the Platform subject to the stated particularities and applied automatically during the contracting process in its final phase. The Customer may communicate with the Cleaner to confirm the final price of the requested products.
For any information about the requested order, the User shall contact 4LABS DETAIL through the Contact section on the website and app, or via email indicating the reason in the subject line, or by telephone.
The Customer may be in direct contact with the Cleaner from the time the service is contracted until its completion and thereafter.
The User acknowledges and accepts that all intellectual and industrial property rights over the contents and/or any other elements inserted in the Application and/or Website (including, without limitation, trademarks, logos, trade names, texts, images, graphics, designs, sounds, databases, software, flow charts, presentation, audio and video), belong to 4LABS DETAIL. 4LABS DETAIL authorizes the User to use, view, print, download and store the contents and/or the elements inserted in the Application and/or Website exclusively for their personal, private and non-profit use, refraining from performing any act of decompilation, reverse engineering, modification, disclosure or supply. Any other use or exploitation of any content and/or other elements inserted in the Application and/or Website other than those expressly provided for herein shall be subject to the prior authorization of 4LABS DETAIL.
Personal data (hereinafter, the “Data”) that the User provides through the Registration Form will be integrated into a personal data file for which 4LABS DETAIL is responsible. For more information, please consult the Privacy Policy.
Right of withdrawal and cancellation of Reservations and orders
The User may cancel an order free of charge as long as the payment has not been made through the Web or the App. Given the nature of the service offered by 4LABS DETAIL, the User is aware that once payment has been made and a Cleaner has been assigned to the requested washing service, the execution of the service mandate is considered to have begun, and therefore the User will not have the right to withdraw from the service request free of charge.
Therefore, if the User cancels an order that already has a Cleaner assigned, the Platform will generate a cancellation cost for the User equal to 100% of the basic delivery fee.
In the event that the Customer has provided an incorrect address for the service, they may provide a new address at any time as long as it is within the same city as the initial order and within the Cleaner's scope of application. If it is located in another city or area from the one initially indicated, it cannot be modified for delivery to a new city and the order will be cancelled, with the Customer assuming the costs generated as established in this clause.
4LABS DETAIL reserves the right to cancel an order without needing to allege just cause. In the event of a cancellation initiated by 4LABS DETAIL, the User will be entitled to a refund of the amount paid.
4LABS DETAIL has official complaint forms available to the consumer regarding the service offered by 4LABS DETAIL. The aforementioned complaint forms can be requested by the consumer through the Contact Form, and the option to access them will be sent automatically. The consumer must specify in the email the exact location from which the request is made, which must coincide with the location where the service was performed; in case of doubt, the latter will be the place where the complaint must be filed.
The Customer has the option to request through the Platform the in-person acquisition by the Cleaner of a series of services related to vehicle washing. The Customer can select from a menu within the Platform a series of predetermined options indicating the characteristics and the price of the services offered.
Once the Customer selects one of the options, they may also complete the order through a free text space to incorporate more detailed information or instructions for the Cleaner in charge of carrying out said service.
The Customer is aware and accepts that the descriptions and, where applicable, the prices of the services offered on the Platform are made based on the information and documentation provided by 4LABS DETAIL
Likewise, the Customer accepts that all services reflected on the 4LABS DETAIL platform are subject to the availability of 4LABS DETAIL
4LABS DETAIL reserves the right to withdraw any service from its platform, as well as to modify the content of its file at any time, without any type of liability being attributed to it.
The price of the service will be as indicated through the Platform.
The Customer will have continuous contact with the Cleaner, who will act on their behalf in carrying out the contracted vehicle washing services; therefore, any change or variation will be communicated by the Cleaner prior to the execution of the mandate for the Customer's approval. Should the Customer wish to make any remarks regarding the placed order, they will always have the possibility to contact the Cleaner executing the granted mandate.
Similarly, during the payment gateway process, the Customer will be informed of the final price of the service and the approximate time of service performance according to the 4 LABS Detail service conditions expressed above.
The Customer may pay for the services using their credit card. To this end, the Customer must provide their card details through the platform as a payment method associated with their account. 4 LABS Detail does not store the card number on its servers and can only view the last four digits. Full information will be stored on the servers of the payment service provider that processes payments on behalf of 4 LABS Detail. Credit card payment will not involve any extra cost for the Customer. All of this is in accordance with the terms of the payment platform set out in Clause 6.1.
Users are fully responsible for the access and correct use of their profile and other contents of the Platform subject to current legislation, whether national or international of the Country from which they use the Platform, as well as the principles of good faith, morals, good customs, and public order. Specifically, they commit to diligently observe these General Conditions of Use.
Users shall refrain from using their profile and the rest of the contents of the Platform for illegal purposes or effects that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect, or impair the Platform, its contents, and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of the Platform by other Users.
4 LABS Detail cannot be considered an editorial responsible party, and expressly declares that it does not identify with any of the opinions that Users of the Platform may issue, for the consequences of which the issuer is entirely responsible.
Those who breach such obligations shall be liable for any harm or damage they cause. 4 LABS Detail shall not be liable for any consequence, damage, or harm that could derive from such access or illegal use by third parties.
In general, Users commit, including but not limited to:
Not to alter or modify, totally or partially, the Platform, bypassing, deactivating or manipulating in any other way its functions or services;
Not to infringe industrial and intellectual property rights or the rules regulating the protection of personal data;
Not to use the Platform to insult, defame, intimidate, violate the self-image of or harass other Users; – Not to access the email accounts of other Users;
Not to introduce computer viruses, defective files, or any other computer program that may cause damage or alterations to the content or systems of 4 LABS Detail or third parties;
Not to send massive and/or repetitive emails to a plurality of people, nor send third-party email addresses without their consent;
Not to carry out advertising actions for goods or services without the prior consent of 4 LABS Detail.
Any User may report another User when they consider that they are breaching these General Conditions of Use; likewise, all Users can inform 4 LABS Detail of any abuse or violation of these conditions through the Contact section. 4 LABS Detail will verify this report as soon as possible and will adopt the measures it deems appropriate, reserving the right to remove and/or suspend any User from the Platform for non-compliance with these General Conditions of Use. Likewise, 4 LABS Detail reserves the right to remove and/or suspend any message with illegal or offensive content, without prior notice or subsequent notification.
The User may unsubscribe from the Platform by communicating it via email through the address provided in the Contact section.
The User is responsible for having the necessary services and equipment for Internet browsing and for accessing the Platform. In the event of any incident or difficulty in accessing the Platform, the User may report it to 4 LABS Detail through the Contact section, which will proceed to analyze the incident and provide instructions to the User on how to resolve it as quickly as possible.
4 LABS Detail does not control nor is it responsible for the content posted by Users through the Platform, the latter being solely responsible for the legal compliance of said content.
4 LABS Detail shall not be liable in the event of service interruptions, connection errors, lack of availability or deficiencies in the Internet access service, nor for Internet network interruptions or for any other reason beyond its control.
4 LABS Detail is not responsible for any security errors that may occur nor for any damage that may be caused to the User's computer system (hardware and software), or to the files or documents stored therein, as a result of:
The presence of a virus in the User's computer system or mobile terminal used for connection to the Platform's services and contents;
A malfunction of the browser;
The use of non-updated versions of the same.
4 LABS Detail has no obligation to control and does not control the use that Users make of the Platform and, consequently, does not guarantee that Users use the Platform in accordance with the provisions of these General Conditions of Use, nor that they make diligent and/or prudent use of it. 4 LABS Detail has no obligation to verify and does not verify the identity of Users, nor the veracity, validity, completeness and/or authenticity of the data they provide.
4 LABS Detail excludes any liability for damages of any nature that may be due to the illegal use of the Platform by Users or that may be due to the lack of veracity, validity, completeness and/or authenticity of the information that Users provide to other Users about themselves and, in particular, although not exclusively, for damages of any nature that may be due to the impersonation of a third party carried out by a User in any kind of communication made through the Platform. In particular, 4 LABS Detail is not responsible for the use of the application as well as for the orders that a third party may make from the User's account.
Without prejudice to the above, 4 LABS Detail reserves the right to limit, totally or partially, access to the Platform to certain Users, as well as to cancel, suspend, block or delete certain types of content, through the use of technological instruments suitable for this purpose, if it has effective knowledge that the activity or information stored is illegal or that it damages property or rights of a third party. In this sense, 4 LABS Detail may establish the necessary filters in order to prevent illegal or harmful content from being poured into the network through the service. The provision of content by Users through the Platform will imply the transfer to 4 LABS Detail of all exploitation rights derived from the content provided on the Platform.
4 LABS Detail may eventually carry out additional checks and implement procedures designed to help verify or check the identities of Cleaners. In this sense, when a User reaches Cleaner status, it simply indicates that said user has completed the corresponding registration process and has accepted these General Conditions of Use and any other particular condition that may be applicable. It does not imply either certification or endorsement regarding their reliability, suitability, and/or security by 4 LABS Detail.
Therefore, 4 LABS Detail recommends that Customers always use common sense and full attention when delegating a service to a specific Cleaner.
As members of the Platform, Users accept that any legal liability they intend to exercise as a consequence of actions or omissions of other Users of the Platform or third parties will be limited to said Users or third parties, and no liability action against 4 LABS Detail shall proceed.
4 LABS Detail reserves the right to modify, at any time and without prior notice, these General Conditions of Use, the Privacy Policy, and the Cookies Policy. Users must carefully read these General Conditions when accessing the Platform. In any case, acceptance of the General Conditions will be a preliminary and indispensable step to access the services and content available through the 4 LABS Detailapp Platform.
Likewise, 4 LABS Detail reserves the power to carry out, at any time and without the need for prior notice, updates, modifications, or deletion of information contained in its Platform regarding its configuration and presentation, as well as the conditions of access, without assuming any responsibility for it. 4 LABS Detail does not guarantee the absence of interruptions or errors in accessing the Platform or its content, nor that it is always updated; however, 4 LABS Detail will carry out, provided that there are no causes that make it impossible or difficult to execute, and as soon as it has notice of errors, disconnections, or lack of updated content, all those tasks aimed at correcting the errors, restoring communication, and updating the contents.
4 LABS Detail is the owner or licensee of all intellectual and industrial property rights included in the Platform as well as the content accessible through it. The intellectual property rights of the Platform, as well as: texts, images, graphic design, navigation structure, information, and content collected therein are the property of 4 Labs Detail, who holds the exclusive exercise of the exploitation rights of the same in any form and, especially, the rights of reproduction, distribution, public communication, and transformation, in accordance with Spanish legislation on intellectual and industrial property rights.
The authorization to the User to access the Platform does not imply a waiver, transmission, license, or total or partial transfer of intellectual or industrial property rights by 4 Labs Detail. It is not permitted to delete, circumvent, or manipulate in any way the contents of the 4 Labs Detail Platform. Furthermore, it is prohibited to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, process, or distribute in any way all or part of the contents included in the 4 Labs Detail Platform for public or commercial purposes, without the express written authorization of 4 Labs Detail or, where appropriate, the holder of the corresponding rights.
The User who proceeds to share any type of content through the Platform ensures that they hold the necessary rights to do so, leaving 4 Labs Detail exempt from any responsibility regarding the content and legality of the information offered. The provision of content by Users through the Platform will involve the assignment to 4 Labs Detail, free of charge, and to the maximum extent permitted by current legislation, of the intellectual or industrial property exploitation rights derived from such content.
If any of the clauses of these General Conditions were to be null and void or voidable, it shall be considered as not having been included. Such declaration of nullity shall not invalidate the rest of the Contract, which shall maintain its validity and effectiveness between the Parties.
The relationship between 4LABS DETAIL and the User shall be governed and interpreted in accordance with these General Conditions which, in matters of interpretation, validity, and execution, shall be governed by Spanish law; and any controversy shall be submitted to the Courts of Palma de Mallorca, unless the User requests the courts of their home residence.
